Plain-language summary
These terms describe what you can expect from FEESZ and what we expect from you. Use the Services responsibly, respect third-party rights, and we will treat your content with the same care we want ours to be treated. For anything specific to your contract, your order form prevails.
1. Acceptance of these terms
By accessing or using feesz.com, the FEESZ console, our APIs, SDKs or any related service (collectively, the "Services"), you agree to these Terms of Use. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these terms.
2. Accounts and access
You are responsible for maintaining the confidentiality of your account credentials and API keys, for any activity that occurs under your account, and for ensuring that authorized users comply with these terms. You must promptly notify FEESZ of any unauthorized access or security incident.
3. Acceptable use
You agree not to misuse the Services, including by attempting to interfere with their normal operation, reverse engineering except where permitted by law, scraping data outside of approved API endpoints, or using the Services to violate the rights of any third party. FEESZ may suspend access in case of material breach.
4. Customer content and rights
You retain all rights to the content you submit to the Services. You grant FEESZ a limited license to process, fingerprint, store and analyze that content solely for the purpose of providing the Services. We do not sell your data and we do not use it to train models that benefit third parties.
5. Fees, billing and renewals
Paid subscriptions are billed in advance on a monthly or annual basis according to your order form. Unless otherwise stated, fees are non-refundable. Subscriptions automatically renew for successive terms equal to the original term unless either party gives notice at least 30 days before the renewal date.
6. Term and termination
Either party may terminate the agreement for material breach if the breach is not cured within 30 days of written notice. Upon termination, your right to access the Services ceases immediately, and FEESZ will delete or return your content within 60 days unless legally required to retain it.
7. Warranties and disclaimers
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, FEESZ disclaims all warranties not expressly set out in these terms, including merchantability, fitness for a particular purpose and non-infringement.
8. Limitation of liability
To the maximum extent permitted by law, in no event will FEESZ be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenues, data or business opportunities. FEESZ's total aggregate liability under these terms is capped at the fees paid in the 12 months preceding the claim.
9. Governing law
These terms are governed by the laws of the jurisdiction stated in your order form. Any dispute that cannot be resolved amicably will be submitted to the exclusive jurisdiction of the competent courts in that jurisdiction.
10. Changes to these terms
We may update these terms from time to time. Material changes will be notified to account administrators at least 30 days before they take effect. Continued use of the Services after the effective date constitutes acceptance of the updated terms.
